1. Agreement
These Terms of Use and End User License Agreement (“Terms”) form a legal agreement between you and PPLST Tech Private Limited (“PPLST Tech,” “we,” “us,” or “our”) for the Tratak mobile application, website, and related materials (together, “Tratak”). By downloading, installing, accessing, or using Tratak, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Tratak.
2. Eligibility and supervision
You must be legally capable of agreeing to these Terms. A parent or guardian must agree and supervise use by anyone below the age of legal majority in their location.
3. License and acceptable use
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use Tratak on devices you own or control, solely for lawful personal use and as permitted by the applicable app-store usage rules.
You may not copy, sell, rent, sublicense, distribute, modify, reverse engineer, attempt to extract source code except where applicable law expressly permits it, bypass technical protections, or use Tratak to create a competing or unlawful service.
You must not interfere with Tratak, introduce malicious code, probe security without written permission, violate others’ rights, misrepresent the service, or use it unlawfully.
4. Service and availability
Tratak provides a digital focal flame, session timing, optional local history, reminders, ambient audio, and export. Features may vary by device. We may change, suspend, or discontinue features, and do not guarantee uninterrupted, error-free, or permanent availability.
5. Health and medical disclaimer
Tratak is a general concentration and meditation aid. It is not a medical device, medical advice, diagnosis, prevention, monitoring, or treatment, and does not replace a qualified professional. We make no promise about eyesight, attention, sleep, cognition, mental health, or any other outcome.
Focused screen viewing may be uncomfortable or unsuitable for some people. Stop immediately at any irritation or discomfort. Seek professional advice before use if you have an eye condition or recent eye procedure, migraine or seizure sensitivity, photosensitivity, balance symptoms, or another relevant condition. 6. Your responsibility and assumption of risk
You decide whether Tratak is suitable for you and are solely responsible for your environment, device placement, posture, viewing distance, brightness, session length, supervision of minors, and decision to begin, continue, or stop. You voluntarily assume the risks associated with sustained screen gazing and use of the app.
Do not use Tratak while driving, walking in traffic, operating equipment, or during any safety-critical activity. Tratak does not require a physical candle. If you independently use fire, you assume all resulting risks and are solely responsible for fire safety, people, animals, and property.
7. Data and privacy
Local records may be lost through deletion, device loss, storage clearing, corruption, backups, or operating-system changes. You are responsible for device security, backups, and exported files. Our limited Analytics use is described in the Privacy Policy.
8. Notifications and third-party services
Reminders, notification silencing, app stores, operating systems, and other third-party services may fail, change, or become unavailable. Never rely on Tratak for alarms, emergencies, or safety-critical communications. Third-party terms also apply, and we are not responsible for third-party services or conduct.
9. Intellectual property
Tratak’s code, design, flame rendering, branding, text, and other materials are owned by or licensed to PPLST Tech and protected by applicable law. These Terms provide a license to use Tratak, not ownership.
10. Warranty disclaimer
To the maximum extent permitted by law, Tratak and all related content are provided “as is” and “as available,” without any express, implied, or statutory warranty, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, safety, reliability, availability, or results.
11. Limitation of liability
To the maximum extent permitted by applicable law, PPLST Tech, its affiliates, directors, officers, employees, contractors, licensors, and service providers (together, the “Released Parties”) will not be liable for any claim, injury, illness, irritation, loss, or damage of any kind arising from or related to Tratak, its content, your use or inability to use it, your decision to continue practising, your failure to follow safety guidance, or any physical candle you choose to use.
This includes eye irritation, dryness, strain, pain, headache, migraine, seizure, dizziness, nausea, visual disturbance, disorientation, falls, burns, fire, personal injury, death, property damage, data loss, loss of wellbeing, and any direct, indirect, incidental, special, consequential, exemplary, or punitive loss, whether based on contract, warranty, tort (including negligence), strict liability, product liability, or another legal theory, even if foreseeable or if a Released Party was advised of the possibility.
Where liability cannot be fully excluded, the Released Parties’ total aggregate liability arising from Tratak will, to the maximum extent permitted by law, not exceed the greater of the amount you paid for Tratak during the 12 months before the event giving rise to the claim or INR 1,000. Except for remedies that applicable law requires, your sole remedy for dissatisfaction is to stop using and uninstall Tratak.
Nothing in these Terms excludes or limits liability or consumer rights that applicable law does not allow us to exclude or limit.
12. Indemnity
Where permitted by law, you will indemnify and hold the Released Parties harmless from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful use, misuse, physical-candle use, or material breach of these Terms.
13. Changes and termination
You may stop using and uninstall Tratak at any time. We may update these Terms, suspend hosted content, or terminate the license for misuse, security, legal compliance, or material breach. The updated date will appear above. Provisions intended to survive termination remain effective.
14. Apple App Store terms
If you obtained Tratak through Apple’s App Store, these Terms are between you and PPLST Tech, not Apple. The license is limited to Apple-branded products you own or control as permitted by Apple’s Usage Rules, including eligible Family Sharing. PPLST Tech, not Apple, is responsible for Tratak, maintenance, support, warranties, product claims, legal compliance, and intellectual-property claims.
If Tratak fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. You must comply with applicable third-party terms and represent that United States law does not prohibit you from receiving or using Tratak because of your location or inclusion on a restricted-party list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce this section.
15. Governing law and general terms
These Terms are governed by Indian law. Subject to mandatory consumer rights and jurisdiction rules, courts in Gurugram, Haryana, India have exclusive jurisdiction. Please contact us before filing a claim so we can try to resolve it informally.
If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. These Terms and incorporated policies are the entire agreement concerning Tratak.
